Terms of Use & Disclosures
BigMoney provides general information for educational purposes only — not investment, tax, or legal advice. Investing involves risk, including loss of principal.
1. Acceptance of These Terms
These Terms of Use & Disclosures (the “Terms”) govern your access to and use of the BigMoney website, web application, APIs, and all related content, features, and outputs (collectively, the “Service”), which are provided by the independent publisher of BigMoney (the “Publisher,” “we,” “us,” or “our”).
By accessing or using the Service, or by checking the acknowledgment box and selecting “Accept,” you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
2. Educational Purposes Only — Not Investment, Tax, or Legal Advice
The Service provides general information and analytical tools for educational and informational purposes only. Nothing in the Service constitutes, or should be relied upon as, investment, financial, tax, legal, accounting, insurance, or other professional advice, or as a recommendation, endorsement, or solicitation to buy, sell, or hold any security, fund, or other financial product, or to adopt any investment, trading, or tax strategy.
The content of the Service is general in nature and is not tailored to your personal financial situation, investment objectives, risk tolerance, time horizon, tax position, or needs. Information you enter into the Service is used only to run automated calculations; it does not turn any output into personalized advice. You should not make any investment, tax, legal, or financial decision based solely on the Service.
3. No Adviser-Client, Fiduciary, or Professional Relationship
Your use of the Service does not create an investment adviser–client, broker–customer, fiduciary, financial-planner, accountant–client, attorney–client, or any other professional relationship between you and the Publisher. The Publisher owes you no fiduciary duty and does not undertake to monitor your accounts, portfolio, or circumstances.
Communications through the Service, including questions submitted to its reference library or other features, are not protected by any attorney–client, accountant–client, or other professional privilege.
4. The Publisher Is Not a Registered Investment Adviser, Broker-Dealer, Financial Planner, CPA, or Attorney
The Publisher is not registered as an investment adviser with the U.S. Securities and Exchange Commission or any state securities regulator, is not a broker-dealer or a member of FINRA, and is not a certified financial planner, certified public accountant (CPA), enrolled agent, tax preparer, or licensed attorney. The Publisher does not provide personalized investment, tax, or legal advice and does not act as an investment adviser, broker, or dealer for anyone.
The Service is a self-directed software tool. It does not execute trades, hold or manage customer funds or securities, take custody of assets, or exercise discretion over any account.
5. Not an Offer or Solicitation
Nothing in the Service is an offer to sell, or a solicitation of an offer to buy, any security, fund, or other financial product or service in any jurisdiction. References to specific companies, ticker symbols, funds, ETFs, or strategies are for illustration and education only and are not a recommendation or endorsement of any issuer, security, or strategy.
Securities and strategies discussed in the Service may not be suitable for you, and some may not be available where you live.
6. Signals, Scores, Price Levels, Screens, and Allocations Are Automated, Hypothetical Model Outputs
Signals and labels (for example, “Bullish,” “Neutral,” “Bearish,” or “Not rated”), scores, ratings, probabilities, conviction levels, fair-value estimates, entry zones, stop-loss and target price levels, Elliott Wave and Fibonacci levels, watch-list screens (such as “Ones to Watch”), portfolio allocations and weights, and tax or planning estimates are generated automatically by quantitative models and software rules. They are hypothetical model outputs — not recommendations, not personalized advice, and not instructions to trade.
Models rely on simplifying assumptions, historical data, and third-party inputs that may be incomplete or wrong, and they can and do produce errors. Model outputs do not account for your complete financial situation, transaction costs, taxes, liquidity, or current market conditions, and they may change at any time without notice. A favorable signal, score, or level is not an indication that any security will perform well.
7. Projections and Forward-Looking Statements Are Hypothetical
Multi-year price projections, percentile ranges (such as 20th, median, and 80th percentile paths), expected and median returns, probability estimates, retirement, college-savings, net-worth, and “what-if” simulations, and other forward-looking statements are hypothetical illustrations based on model assumptions. They are not forecasts, predictions, promises, or guarantees of future results.
Hypothetical results have inherent limitations: they are prepared with the benefit of hindsight and assumptions, do not reflect actual trading or actual investment accounts, and do not reflect the impact that economic and market factors, fees, commissions, slippage, or taxes might have had on actual decision-making. Actual results will differ, possibly materially, from any projection shown.
8. Past Performance Does Not Guarantee Future Results
Past performance — whether actual, back-tested, or simulated — is not indicative of, and does not guarantee, future results. Historical prices, returns, indicator readings, and chart patterns may not repeat.
9. Investment Risk, Including Loss of Principal
All investing involves risk, including the possible loss of some or all of your principal. Securities prices can be volatile, may decline rapidly, may gap past stop or limit levels, and may become illiquid. Concentrated positions, leverage, options, short selling, frequent trading, and tax-loss harvesting carry additional risks. Diversification and asset allocation do not ensure a profit or protect against loss in declining markets.
Never invest money you cannot afford to lose.
10. Third-Party Market Data and SEC Filing Data
The Service displays and processes market prices, quotes, fundamentals, news, and regulatory filing data (including data derived from U.S. Securities and Exchange Commission filings) obtained from third-party sources, and it may display simulated, sample, or fallback data when live sources are unavailable. Such data may be delayed, inaccurate, incomplete, out of date, or unavailable, and it may not be labeled as such everywhere it appears.
All data is provided “AS IS” and “AS AVAILABLE,” without warranty of any kind, for informational purposes only and not for trading purposes. Neither the Publisher nor any third-party data provider is responsible for errors, omissions, interruptions, or delays in any data, or for any action taken in reliance on it. Always verify prices and data with your broker or an official source before acting.
11. Trademarks, Data Ownership, and No Affiliation or Endorsement
Company names, ticker symbols, product names, publication names, logos, and trademarks referenced in the Service, including the names of market-data providers, news organizations, and government agencies, are the property of their respective owners. Third-party data and content remain the property of their respective owners and licensors.
References to any third party are for identification and attribution only. The Publisher is not affiliated with, sponsored by, or endorsed by any data provider, exchange, publication, news organization, government agency, or company referenced in the Service, and no such party has reviewed or approved the Service or its outputs.
12. Tax, Legal, and Financial-Planning Information Is General — Consult a CPA or Attorney
Tax-rate tables, state tax profiles, tax-loss-harvesting and wash-sale analyses, descriptions of tax strategies (including anything labeled a “legal” strategy or “loophole”), retirement-account, HSA, 529, estate, debt, and cash-flow analyses, and similar content are general educational information. They are not tax, legal, or accounting advice, may not reflect current law or your specific facts, and may contain errors or omissions.
Tax and other laws are complex, change frequently, and apply differently depending on your circumstances. Before acting on any tax, legal, estate, or financial-planning information, consult a qualified certified public accountant (CPA), enrolled agent, tax attorney, or other licensed professional. The Publisher does not prepare tax returns and is not responsible for any taxes, penalties, or interest you may owe.
13. Reference-Library and Other Automated Content
The reference library (the “Ask” chat and consultation features) returns summaries written by the Publisher that are selected automatically by keyword matching and other software rules. These features do not use an artificial-intelligence language model unless a feature expressly says so. Automated content may be inaccurate, incomplete, outdated, or misleading, may misstate laws, figures, or sources, and may not match your question. A citation or link to an official source does not mean that the source supports the content shown.
Automated content is provided for general educational purposes only and is not investment, tax, legal, or other professional advice. Do not rely on it without independent verification, and do not enter sensitive personal information, such as Social Security numbers, account numbers, or passwords, into free-text fields.
14. Your Responsibility, Independent Verification, and Licensed Professionals
You are solely responsible for your own investment, trading, tax, legal, and financial decisions and for evaluating the merits and risks of any information provided by the Service. You agree to independently verify all information before relying on it.
Before making any financial decision, consult a licensed professional — such as a registered investment adviser, a broker-dealer representative, a certified financial planner, a CPA, or an attorney — who can evaluate your individual circumstances. You are responsible for the accuracy of any information you enter into the Service and for keeping your sign-in credentials secure.
15. No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT, DATA, MODEL OUTPUTS, AND AUTOMATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THE PUBLISHER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, COMPLETENESS, TIMELINESS, QUIET ENJOYMENT, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
THE PUBLISHER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT ANY DATA OR OUTPUT IS ACCURATE OR RELIABLE, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR ACHIEVE ANY PARTICULAR RESULT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE PUBLISHER OR ITS AFFILIATES, CONTRIBUTORS, LICENSORS, OR DATA PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY TRADING OR INVESTMENT LOSSES, LOST PROFITS, LOST OPPORTUNITIES, TAXES, PENALTIES, OR INTEREST, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE, ANY CONTENT, DATA, MODEL OUTPUT, OR AUTOMATED CONTENT, OR YOUR RELIANCE ON ANY OF THEM, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF THE PUBLISHER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PUBLISHER’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO THE PUBLISHER FOR THE SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
These limitations are an essential basis of the bargain between you and the Publisher and apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you; in that case, the Publisher’s liability is limited to the fullest extent permitted by law.
17. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Publisher and its affiliates, contributors, licensors, and data providers from and against all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to (a) your use or misuse of the Service, (b) your investment, trading, tax, or financial decisions, (c) your violation of these Terms, or (d) your violation of any law or of the rights of any third party.
18. Privacy
We design the Service to minimize the personal information it handles. Your financial data is encrypted at rest on a per-user basis, personal identifiers are removed or replaced with tokens before data is processed by the Service’s analytical components, and we do not sell your personal data. Our record of your acceptance of these Terms contains only the version accepted and the time of acceptance, linked to an internal account identifier (or, in the shared demo, to your current browser session).
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Do not enter information you are not comfortable storing in the Service.
19. Eligibility
The Service is intended only for individuals who are at least 18 years old (or the age of majority where they live) and who reside in the United States. Its content is informational, is designed around U.S. federal and state rules, and is not directed to anyone in a jurisdiction where its availability or use would be contrary to local law or regulation. By using the Service, you represent that you meet these requirements.
20. Changes to These Terms and to the Service
We may update these Terms from time to time. Each update is identified by a new version and effective date shown at the top of this page. When we publish a new version, you will be asked to review and accept it before you continue to use the Service; if you do not agree to an updated version, you must stop using the Service.
We may modify, suspend, or discontinue any part of the Service, including any data source, model, or feature, at any time without notice or liability.
21. Governing Law, Severability, and Entire Agreement
These Terms are governed by the laws of the United States and of the state in which the Publisher is domiciled, without regard to conflict-of-law rules. Except where applicable law provides otherwise, any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts with jurisdiction over the place where the Publisher is domiciled, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and the Publisher regarding the Service and supersede any prior agreements on that subject.
22. Contact
